Mitchell Hasenkampf is a Partner at the Herman Law Firm, where he represents exclusively the managed care industry, predominantly in compliance matters. Frequent areas of representation include:

  • OON Provider – Plan payment disputes, whether in litigation, arbitration, or otherwise
  • Regulatory compliance for government plans, including Medicaid Managed Care, Medicare Advantage, and plans for dual eligibles such as MMPs and DSNPs
  • Marketing, outreach, and member communications, including member materials such as EOBs and provider directories
  • Member incentives, including AKS and CMP compliance
  • Overpayment assessment and recovery for both commercial and government plans
  • Reviewing and negotiating provider and vendor agreements, including drafting regulatory addenda
  • ERISA litigation involving health benefits, including medical necessity determinations and air ambulance payment disputes
  • Utilization Review and prompt pay requirements for both government and commercial plans
  • Parity and Civil Rights mandates, including Section 1557 compliance with notice and tagline requirements
  • Health Risk Assessments and Care Management
  • Member and Provider Grievance and Appeal processes

Mr. Hasenkampf has argued successfully in federal and state courts across multiple jurisdictions, as well as local administrative entities. Prior to joining the Herman Law Firm, Mr. Hasenkampf practiced in the commercial litigation group of a large law firm as well as for a litigation boutique.
